EXPLANATORY NOTES

Geographical positions refer directly to the graduations of the largest scale Canadian Hydrographic chart unless otherwise indicated.

Bearings  refer to the true compass and are measured clockwise from 000° (North) clockwise to 359°; those relating to lights are from seaward.

Visibility of lights is that in clear weather.

Depths  - The units used for soundings (metres, fathoms or feet) are stated in the title of each chart.

Elevations   are normally given above Higher High Water, Large Tides unless otherwise indicated.

Distances  may be calculated as follows:

1 nautical mile = 1 852 metres (6,076.1 feet)

1 statute mile = 1 609.3 metres (5,280 feet)

1 metre = 3.28 feet

Temporary & Preliminary Notices are indicated by a (T) or a (P) before the chart action and in the section 1. Please note that Nautical charts are not amended by the Canadian Hydrographic Service for Temporary (T) and Preliminary (P) Notices. It is recommended that mariners chart these corrections in pencil. Listing of charts affected by Temporary and Preliminary Notices are revised and promulgated quarterly in Section 1 of the Monthly Edition .

Please note that, in addition to the temporary and preliminary changes normally advertised as (T) and (P) Notices, there are a few permanent changes to navigational aids that have been advertised as Preliminary Notices to Mariners while charts are being updated for new editions.

Marine Information Report & Suggestion Sheet -  Mariners are requested to notify the responsible authorities when new or suspected dangers to navigation are discovered, changes observed in aids to navigation or corrections to publications are seen to be necessary. Such communications can be made using the Marine Information Report & Suggestion Sheet inserted on the last page of each monthly edition of Notices to Mariners.

Corrections to nautical charts will be listed in numeric order by chart number. Each chart correction listed applies only to that particular chart. Related charts, if any, will have their own specific correction listed separately. Users should also refer to CHS Chart 1 Symbols, Abbreviations Terms for additional information pertaining to the correction of charts. The illustration below describes the elements that will comprise a typical Section 2 chart correction.

ADVISORY


NOTICES TO SHIPPING (WRITTEN AND BROADCAST)



The Canadian Coast Guard is implementing a number of changes to the aids to navigation system in Canada .


These changes are advertised as Notices to Shipping (Broadcast and Written) by the Canadian Coast Guard and are followed up with Notices to Mariners, then charts are updated by hand correction, reprints or new editions.


Mariners are advised that all relevant Written Notices to Shipping should be kept until superseded by Notices to Mariners or through revised charts issued by the Canadian Hydrographic Service.


Written Notices to Shipping are published weekly and are available from local Canadian Coast Guard Offices.


The Canadian Hydrographic Service is reviewing the impact of these changes with the Canadian Coast Guard and together we are preparing an action plan on the issuing of chart revisions.

CANADIAN HYDROGRAPHIC SERVICE - CURRENT CHART EDITION DATES


CHART EDITIONS


The three terms described below are used to indicate the publication status of Canadian charts.


NEW CHART - "NEWCHT"


The first publication of a Canadian chart embracing an area not previously charted to the scale shown, or embracing an area different from any existing Canadian chart.


NEW EDITION - "NEWEDT"


A new issue of an existing chart containing amendments essential to navigation in addition to those issued in Notices to Mariners and making existing editions obsolete.


REPRINTS


A new issue of the current edition of a chart incorporating no amendments of navigational significance other than those previously promulgated in Notices to Mariners. It may also contain amendments from other sources provided they are not essential to navigation. Previous printings of the current edition remain in force.

CANADIAN HYDROGRAPHIC SERVICE - PRINT ON DEMAND CHARTS - CARE AND USE

Background

By providing nautical charts to the public, the goal of the Canadian Hydrographic Service (CHS) is to provide services for safe navigation in a fiscally responsible manner. As a result, CHS continues to expand its portfolio of nautical paper charts that are printed using Print On Demand (POD) technology. These charts are easily recognized by their whiter paper and the coloured logo of the Canadian Hydrographic Service. This new technology enables CHS to print charts in a more efficient manner while enhancing chart content through being able to quickly add new and important information. POD technology provides customers with up-to-date charts without the historical hand-drawn corrections or glued-on patches. Additionally, this technology eliminates out-of-stock situations which arise with the traditional printing and warehousing methods. In the event of a national emergency, CHS can respond to the appropriate authorities with best available information very quickly.

Care of Your POD Chart

CHS encourages its customers to handle the POD charts more carefully than the traditional lithographic charts. When plotting information on POD charts, use HB pencils and apply limited pressure. Testing has suggested that an Indian gum eraser is more effective than alternatives when used on the product. This eraser is also suitable for charts printed using lithographic processes.


CANADIAN HYDROGRAPHIC SERVICE - TRANSPORT CANADA NAVIGATION SAFETY - ECDIS


Mariners are advised that ECDIS may not display some isolated shoal depths when operating in "base or standard display" mode. Route planning and monitoring alarms for these shoal depths may not always be activated. To ensure safe navigation and to confirm that a planned route is clear of such dangers, mariners should visually inspect the planned route and any deviations from it using ECDIS configured to display "all data". The automated voyage planning check function should not be solely relied upon.

*803 CANADIAN COAST GUARD PUBLICATION - ANNOUNCEMENT REGARDING LORAN-C SERVICE


In January 2010, both the Canadian Coast Guard (CCG) and the United States Coast Guard (USCG) announced the termination of the Loran-C signal.

The USCG terminated the transmissions of all U.S. domestic Loran-C signals including those covering the Great Lakes on February 8, 2010.

On August 3rd, 2010, the CCG and USCG jointly terminated the Loran-C service covering the East and West coasts of Canada.

Mariners are advised that Loran-C service is no longer available and therefore cannot be used for navigation.

*804 TRANSPORT CANADA (TC) - MARINE COMMUNICATIONS AND TRAFFIC SERVICES (MCTS) - NORTHERN CANADA VESSEL TRAFFIC SERVICES ZONE REGULATIONS - ANNOUNCEMENT REGARDING NORDREG


As of July 1, 2010, the Northern Canada Vessel Traffic Services (NORDREG) Zone reporting system became mandatory for certain vessels. The NORDREG Zone, which covers Canada's northern waters, has also been extended to the outer limit of the exclusive economic zone of Canada. The following vessels are required to report information to NORDREG:

 Vessels of 300 gross tonnage or more;
 Vessels that are engaged in towing or pushing a vessel, if the combined gross tonnage of the vessel and the vessel being towed or pushed is 500 gross tonnage or more; and
 Vessels carrying as cargo a pollutant or dangerous goods, or engaged in towing or pushing a vessel carrying as cargo a pollutant or dangerous goods.

The above vessels destined for the NORDREG Zone or navigating within the zone should contact NORDREG CANADA or the nearest CCG MCTS Centre for full information on how to comply with the new requirements.


*805(P) MARINE COMMUNICATIONS AND TRAFFIC SERVICES (MCTS) - DISCONTINUANCE OF POLL FAX SERVICE


The Canadian Coast Guard intends to permanently discontinue the Marine Facsimile Package, also known as the POLLFAX Service offered by Prescott MCTS Centre.

Comments on this action are solicited from mariners and other interested parties. Comments should be directed by mail to: Frank Dwyer, Officer-in-Charge, Prescott MCTS, P.O. Box 1000, Prescott, ON, K0E 1T0 or by fax (613) 925-4519 or by email at vbr@dfo-mpo.gc.ca within 3 months of this notice.

*806 MARINE COMMUNICATIONS AND TRAFFIC SERVICES (MCTS) - Establishment of Arctic Maritime Safety Information Services - 5 new Arctic NAVAREAs/METAREAs


The International Maritime Organization (IMO), the International Hydrographic Organization (IHO), and the World Meteorological Organization (WMO) announce the establishment of five (5) new Arctic NAVAREAs/METAREAs as part of the expansion of the IMO/IHO World-Wide Navigational Warning Service (WWNWS) into Arctic waters. The limits of the new Arctic NAVAREAs/METAREAs are identified in the attached graphic. Effective 01 July 2010, an International SafetyNET Service for broadcasting navigational warnings and meteorological warnings and forecasts in the English language will be declared to be in an "Initial Operational Capability" (IOC) for these waters with a transition to "Full Operational Capability" (FOC) on 01 June 2011.

During the IOC period, these Arctic NAVAREA/METAREAs will be providing navigational warnings and meteorological warnings and forecasts on an intermittent and test basis. The broadcasting of SafetyNET messages to the new Arctic NAVAREA/METAREAs will be addressed to rectangular area(s) until the SafetyNET receiver modifications with the inclusion of the NAVAREA/METAREAs boundary limits and its identification are in place. Reception of rectangular addressed messages should be automatic providing the ship's position is inside the addressed area. However, mariners are advised to check their manufacturer's operation manuals to obtain information on the setting of their EGC receivers to receive relevant SafetyNET messages.

2. Marine Protected Areas in the Pacific Region of Canada

The following section provides information on Marine Protected Areas that have been designated under the Oceans Act in Canada's Pacific Region.

2.1 Bowie Seamount Marine Protected Area

The Bowie Seamount Marine Protected Area was designated pursuant to the Oceans Act on April 17, 2008. The full text of the regulations may be accessed in the Canada Gazette Part II, Vol. 142, No. 9, 1037-1055. (http://canadagazette.gc.ca)

Coordinates

The Bowie Seamount (Sgaan Kinghlas) is located 180 km west of Haida Gwaii (Queen Charlotte Islands) on Canada's Pacific Coast, and is comprised of Bowie, Hodgkins and Davidson Seamounts of the Kodiak-Bowie seamount chain. The Bowie Seamount Marine Protected Area is bounded by rhumb lines connecting the following geographical

coordinates. All geographic coordinates (latitude and longitude) are expressed in the North America Datum 1983 (NAD 83) geodetic reference system.

Management Zones

The Regulations establish the outer boundary of the MPA. Three internal management zones have been delineated, in which different activities may be permitted, provided that they do not compromise the overall conservation objective of the MPA.

 Zone 1 consists of the fragile and productive photic zone (depth where sunlight penetrates sufficiently) of the Bowie Seamount defined by the 457-metre (250 fathom) bathymetric contour. This area, which is approximately 44 km2, is considered sensitive and is afforded a higher level of protection.
 Zone 2 consists of the Bowie Seamount structure, the surrounding waters, seabed and subsoil, excluding the sensitive upper portion identified in Zone 1. This covers an area of approximately 2 538 km2.
 Zone 3 consists of the Hodgkins and Davidson Seamount structures, the surrounding waters, seabed and subsoil. This area covers approximately 3 549 km2.

Regulatory Requirements for Vessel Passage

The regulations permit the exercise of international navigational rights in the Marine Protected Area year round. Vessels must operate in compliance with all relevant provisions of the Canada Shipping Act and all relevant requirements of the International Maritime Organization. Vessels in non-compliance with these requirements contravene the Marine Protected Area regulations and are also subject to penalties under the Oceans Act.

Vessels must report all accidents or incidents to the Canadian Coast Guard via any Marine Communications and Traffic Services Centre (MCTS) within two (2) hours of occurrence or detection.

Prohibited activities

The Bowie Seamount Marine Protected Area regulations prohibit any activity that shall disturb, damage or destroy, or remove from the Area, any living marine organism or any part of its habitat, or any part of the seabed. The regulations also prohibit any activity — including depositing, discharging or dumping any substance, or causing any substance to be deposited, discharged or dumped — that is likely to result in the disturbance, damage, destruction or removal of a living marine organism or any part of its habitat.

The regulations define exceptions to the general prohibition for the activities set out in the table below.



Exceptions



Commercial fishing that is carried out in accordance with the Fisheries Act and its regulations. At this time sablefish by trap gear takes place in Zone 2 only.


Recreational fishing that is carried out in accordance with the Fisheries Act and its regulations:


Fishing that is carried out in accordance with the Aboriginal Communal Fishing Licenses Regulations


Vessel travel carried out in accordance with the Canada Shipping Act, 2001 and its regulations.


Foreign vessel travel carried out in accordance with the Canada Shipping Act, 2001 and its regulations and foreign ship travel carried out in accordance with the Coasting Trade Act and its regulations;


Any movement or other activity of a ship, submarine or aircraft if the movement or other activity is carried out for the purpose of public safety, law enforcement or national security or for the exercise of Canadian sovereignty as specified in the Bowie Seamount Marine Protected Area Regulations.


Marine scientific research activities that are carried out or sponsored by a foreign government and in respect of which that government has received the consent of the Minister of Foreign Affairs under paragraph 3(2)(c) of the Coasting Trade Act, if the activities are carried out in a manner that complies with the terms and conditions of the consent;


A scientific research, monitoring, educational activities and commercial marine tourism approved by the Minister of Fisheries & Oceans (see Activity Plan section below)


MPA Activity Plans

Every person who proposes to carry out a scientific research, monitoring, educational or commercial tourism activity in the Area shall submit an activity plan to the Minister of Fisheries and Oceans for approval, not less than 60 days before the day on which the activity is proposed to begin.

Reporting of Accidents

Every person involved in an accident that is likely to result in any disturbance, damage, destruction or removal prohibited under section 3 shall, within two hours after its occurrence, report the accident to the Canadian Coast Guard.

Endeavour Hydrothermal Vents Marine Protected Area

Coordinates

The Endeavour area of the Juan de Fuca Ridge is a seismically active area of seafloor formation and hydrothermal venting. The Endeavour Hydrothermal Vent area is located 250 km offshore from Vancouver Island, 2250 m below the ocean's surface and is bounded by rhumb lines connecting the following geographical coordinates. All geographic coordinates (latitude and longitude) are expressed in the North America Datum 1983 (NAD 83) geodetic reference system.

Prohibited activities

The Endeavour Hydrothermal Vents Marine Protected Area regulations prohibit any activity that shall (or is likely to) disturb, damage or destroy, or remove from the Area any part of the seabed, including a venting structure, or any part of the subsoil, or any living marine organism or any part of its habitat.

Exceptions

Exceptions to the above prohibition exists in the event that the disturbance, damage, destruction or removal is for scientific research for the conservation, protection and understanding of the Area. This exception is subject to the submission of a research plan to the Minister of Fisheries and Oceans not less than 90 days before the start of the scientific research in the Area and requires that all licences, authorizations or consents required under the Oceans Act, the Coastal Fisheries Protection Act, the Coasting Trade Act or the Fisheries Act in respect of the scientific research have been obtained.

The regulations further describe exceptions to the general prohibition for the activities set out in the table below.

COSPAS-SARSAT is the international organization that operates a series of satellites in low altitude and geostationary orbits for search and rescue. In response to recommendations from the International Maritime Organization (IMO) and the International Civil Aviation Organization (ICAO), the Council of COSPAS-SARSAT announced at its October 2000 meeting in Laval, Quebec that it will be phasing out satellite processing of distress beacons operating in the 121.5/243 MHz range and encouraging users to adopt 406 MHz beacons by 2009 at the latest, as this is when the switch-over will be completed.

Three types of distress beacons are in use: Emergency Locator Transmitters (ELTs), used on aircraft; Emergency Positioning Indicator Radio Beacons (EPIRBs), used on vessels; and Personal Locator Beacons (PLBs), used by land-based personnel.

The impact of this change should be negligible aboard Canadian vessels as there are no 121.5 MHz marine EPIRBs that have a valid technical acceptance certificate (TAC) under the Radiocommunication Act. Therefore, it is illegal for anyone to sell or fit such an EPIRB in Canada or aboard a Canadian vessel. Only those COSPAS-SARSAT EPIRBs transmitting on 406 MHz are approved for use in Canada and these units will not be impacted by this change in satellite detection.

The use of 406 MHz distress beacons over the 121.5/243 MHz distress beacons will minimize the problems with false alerts being received by rescue coordination centres. Since its inception in 1982 the COSPAS-SARSAT System has provided distress alert information which has assisted in the rescue of over 18,865 persons in 5,317 distress situations.

Mariners are encouraged to fit float-free EPIRBs and register their COSPAS-SARSAT 406 MHz EPIRBs free-of-charge with the Canadian Beacon Registry, P.O. Box 1000 Stn Forces, Astra, ON K0K 3W0, by telephone at 1-877-406-SOS1(7671), by facsimile at 1-877-406-FAX8(3298), by e-mail CBR@sarnet.dnd.ca or on the Website at http://canadianbeaconregistry.forces.gc.ca.

Replace by: 173 A Federal project provides for a 20-foot dredged channel that leads from the mouth of Black River to about 0.4 mile above the Canadian National Railroad bridge, thence an 8- foot channel to the I-94 bridge, thence a 6-foot channel for about 2.1 miles upstream to the head of the project. (See Notice to Mariners and the latest edition of the chart for controlling depths.) A light marks the S side of the river mouth.
